For the protection of new plant varieties - expressly excluded from the list of objects that can be protected by a patent for an industrial invention - the applicant has a special tool: the "industrial right for new plant varieties." Access to this particular type of protection is open to varieties belonging to any plant species, including hybrids.
The most popular procedure in Europe for this type of protection is a Community Plant Right that allows for consistent protection throughout the EU. National procedures are also available, which provide protection only in specific territories.
