Trademarks in Argentina: end of novelty examination

 The Argentine Trademark Office (INPI) has introduced significant changes regarding the examination of new trademark applications and the timing of publication and opposition. 

 As of 11 December 2025, the INPI will no longer examine novelty and therefore will no longer automatically reject applications for trademarks that are identical or similar to those already in the Argentine Trademark Register. It will therefore remain the responsibility of the owners of earlier trademarks to check new trademark applications and take action to prevent their registration.
Furthermore, as of 1 March 2026, the publication of new applications will last only one day and the period for filing oppositions will be only 30 days from the date of publication.
 

How to protect yourself ?

These changes make it crucial to systematically monitor the Trademark Register, allowing owners to take timely action. To this end, we recommend: 

  1.  Activate a surveillance service immediately: this is the only way to intercept conflicting trademark applications before they are registered. 

  2.  Act promptly: after 30 days, the only option is to take legal action to cancel identical or similar third-party trademarks, which is a longer and more expensive process.
