Elena Comoglio

Partner, Dr., Italian and European Patent Attorney entitled to act before the Unified Patent Court, Professional Representative in Community Design matters before the EUIPO. Elena graduated in Biological Sciences at the University of Torino and completed a postgraduate specialization school in Industrial Biotechnology at the University of Torino. In 2016, he attended the Advanced Training Course in Patenting at the State University of Milan. In 2022-2023 she participated in the 7th Edition of the Women Talent Pool Leadership Programme run by the European Network for Women in Leadership.

Work experience
Before joining Jacobacci & Partners in 1998, Elena participated in a research project at Sorin Biomedica Cardio, a medical device company. 
As a patent attorney Elena represents and advises clients ranging from academic and research institutions (mainly Italian and US Universities) to highly specialized local and foreign companies.


Professional focus
Elena has an extensive practice drafting and prosecuting European, Italian and International patent applications relating to biotechnological inventions and has experience in handling oppositions and appeal proceedings before the European Patent Office. 
She is also highly experienced drafting and prosecuting Community Plant Variety Right applications (including third parties objections) and in handling Italian SPC applications. 
Elena regularly provides technical assistance on legal issues, and has drafted numerous infringement and freedom-to-operate opinions. 
Elena is constantly involved as an ex parte technical expert in national and multinational litigations concerning the validity and infringement of pharmaceutical patents and SPCs, relating to, inter alia, patents on pharmaceutical dosage forms, pharmaceutical formulations, new medical indications, new pharmaceutical active ingredients, both chemical and biological, such as antibodies, glycosylated antibodies, fusion proteins. Elena also acts as an ex parte technical expert in litigations relating to the validity and infringement of new plant variety rights.

Areas of expertise
Elena’s primary focus is on biotechnological, medical, plant, diagnostic and pharmaceutical patents, although her range of activities also extends to chemistry. She has particular experience with so-called “second medical applications” and in the fields of nucleic acid techniques (including PCR, SDA and LAMP), diagnostic immuno- and molecular assays, affinity reagents (including polyclonal antibodies, monoclonal antibodies and antibody fragments), transgenic organisms, recombinant peptides and proteins, stem cells, RNA interference, microarray platforms for transcriptomic and proteomic analysis. 
Elena regularly lectures at Italian universities about the protection and patentability of biotechnological inventions. She is the author of Chapter 16 on 'Biotechnological Inventions' in Trattario di diritto civile. Proprietà intellettuale. Mercato e concorrenza. vol.20, P. Cendon (ed.), Giuffré 2018.
